BUREAU OF CONVEYANCES Act 57 Requires the registrar of the bureau of conveyances to provide, within 10 days after each week and free of charge, an image and index of all documents and instruments have been recorded in the registrar's office that week relating to regular system land in all the counties, to the county designated in a memorandum of understanding agreed upon by the counties to act as a central clearinghouse. Act 120 Transfers fee time share interest from the land court system to the regular system; establishes a working group to resolve implementation issues. Establishes a pilot program to implement electronic recording of fee time share interests. CONDOMINIUMS Act 9 Extends the condominium dispute resolution pilot project until 6/30/11. Act 158 Requires condominium associations, planned community associations, and cooperative housing corporations with properties inaccessible to the public to establish a policy to provide access for a person authorized to serve civil process. Sunsets on July 1, 2012. FINANCIAL INSITUTIONS Act 106 Provides for the licensing and regulation of mortgage servicers that service residential mortgage loans secured by real property located in the State of Hawaii. Specifies prohibited practices for mortgage servicers. Effective 7/1/2010. Act 107 Amends and updates Hawaii's code of financial institutions to address temporary office relocations and to place prudent limits on certain kinds of investments by financial institutions. LAND COURT Act 197 Requires the assistant registrar of the land court to provide an image and index of all instruments that contain real property transactions to the county designated as a central clearinghouse under a memorandum of understanding agreement agreed upon by the counties. LEASES Act 189 Clarifies provisions contained in long-term commercial and industrial ground leases. LAND USE Act 53 Amends the permitted uses of land within the agricultural district with soil classifications of A or B to include agricultural education programs conducted on a farming operation. Act 126 Protects and promotes the proper use of Hawaii's best agricultural lands by requiring conditions of approval for subdivisions of agricultural land into smaller lots and farm dwellings, thereby ensuring meaningful agricultural use. Act 144 Requires the Hawaii community development authority to collaborate with and consider the recommendations of the Kakaako Makai Community Planning Advisory Council in developing, accepting, and implementing plans for the development of Kakaako makai. TIME SHARE Act 12 Increases the amount that condominium associations may recover in maintenance fees from the foreclosure of a condominium apartment from $1,800 to $3,600.
